Terms of Service

By adding KyoBot to your Discord server or using the KyoBot web dashboard, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of KyoBot (the "Service"), including the Discord bot and the web dashboard at this domain. By using the Service in any way, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

2. Eligibility

You must be at least 13 years old to use the Service, in accordance with Discord's Terms of Service. If you are between 13 and 18, you represent that you have obtained parental or guardian consent. By using the Service, you warrant that you meet these age requirements.

3. Description of Service

KyoBot is a Discord bot and accompanying web dashboard that provides server management features including, but not limited to: XP leveling, moderation tools, a ticket system, welcome messages, auto-role assignment, birthday tracking, Twitch stream notifications, giveaways, and an auto-responder. Features may change, be added, or be removed at any time.

4. Discord Platform Compliance

Your use of KyoBot must comply with Discord's Terms of Service and Community Guidelines at all times. KyoBot is an independent service and is not affiliated with, endorsed by, or sponsored by Discord Inc. We are not responsible for any actions taken by Discord Inc., including service interruptions, account bans, or platform policy changes.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You, as the server administrator adding KyoBot, are solely responsible for how the bot is used within your Discord server.

6. Prohibited Conduct

You may not use the Service to:

Harass, abuse, threaten, stalk, or harm any individual or group
Distribute spam, malware, phishing content, or unsolicited messages
Promote, facilitate, or engage in any illegal activity
Post, store, or transmit hate speech, illegal content, or material that violates the rights of others
Reverse-engineer, decompile, scrape, or attempt to extract source code from the Service
Circumvent, disable, or interfere with security or access controls
Impersonate KyoBot, its developer(s), or any other person or entity
Sell, transfer, or sublicense access to the Service or any Premium features

We reserve the right to immediately terminate access for any violation of this section.

7. Premium Services

KyoBot offers optional paid features ("KyoBot Premium"). By purchasing Premium:

You agree to the pricing, billing cycle, and payment terms presented at the time of purchase
Subscriptions may auto-renew; you are responsible for cancelling before the renewal date if you do not wish to be charged
We reserve the right to change Premium pricing or features with reasonable advance notice
EU/EEA consumers have a statutory 14-day right of withdrawal from the date of purchase, unless the service has been fully performed with your prior consent. To exercise this right, contact us at stephanospapadopulos@gmail.com within 14 days. Outside the EU, refund requests are considered case-by-case within 7 days of the charge.
Abuse of Premium features or violation of these Terms may result in revocation of Premium access without refund

8. Intellectual Property

KyoBot's code, branding, design, and all related intellectual property are owned by KyoBot's developer(s). You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, reproduce, distribute, or create derivative works without explicit written permission. Your server's content and configuration data remains yours.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KYOBOT AND ITS DEVELOPER(S) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR PREMIUM SERVICES DURING THE 12 MONTHS PRECEDING THE CLAIM, OR €50 — WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless KyoBot and its developer(s) from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your use at any time by removing KyoBot from your server and deleting your dashboard account. Upon termination, provisions that by their nature should survive (including Sections 8–11) will continue to apply. Your data may be retained for up to 30 days following termination before deletion, subject to our Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. Continued use of the Service after any changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the Hellenic Republic (Greece). Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Greece, without regard to conflict of law principles.
